New DNA evidence proves APPEAL client Andy Malkinson is innocent
As reported in The Sunday Times yesterday, new DNA evidence proves that our client Andy Malkinson is and always has been innocent.
Andy spent over 17 years wrongly imprisoned for a stranger rape which the DNA results show was committed by another man.
We are now working hard preparing an application to the Criminal Cases Review Commission, asking the body to send Andy’s case to the Court of Appeal as a matter of urgency, where he can present the fresh DNA evidence.
If Greater Manchester Police support this application, it could greatly speed up the process of getting justice for Andy and his family.
It’s the least that Greater Manchester Police can do after their failure to disclose vital evidence to Andy’s defence at trial and their unlawful destruction of case exhibits.
You can help by writing to Greater Manchester Police’s leadership, asking them to do the right thing and support Andy’s application to the CCRC for a new appeal.

Re: Case of Andy Malkinson – Please act in the interests of justice and public safety
As you will have seen reported in The Sunday Times, new DNA results have shown that another man is responsible for the crime for which Andy Malkinson spent 17 years wrongly imprisoned.
In view of this compelling DNA evidence, I am writing to urge you to support Mr Malkinson’s application for a new appeal hearing.
As a member of the public, I expect that Greater Manchester Police should be willing to acknowledge its past failings and to act in the interests of justice and public safety.
In this case, Greater Manchester Police have admitted there was a serious failure to disclose evidence to the defence at trial. Further, case exhibits have been unlawfully destroyed.
In view of these circumstances and the new DNA results, clearly the interests of justice demand that Mr Malkinson’s conviction is now overturned as soon as possible.
You can help make this happen quickly by directing Greater Manchester Police to support Mr Malkinson’s application to the Criminal Cases Review Commission.
As a concerned citizen and taxpayer, I believe Greater Manchester Police should be using its resources to try to identify and bring to justice the real perpetrator of this violent crime.
Public money should certainly not be used to prevent the full truth of how this terrible miscarriage of justice came to occur from coming to light.
The best way of restoring public confidence in Greater Manchester Police would be for it to acknowledge its past mistakes in this case and to ensure that lessons are learned.
